Mscaler (“Mscaler”, “we”, “our”, “us”) operates the website https://mscaler.com. This Privacy Policy explains how we collect, use, share and protect your information when you visit our website, contact us, use our services or interact with our marketing. The short version

  • We collect the details you give us, such as your name, email, phone number and business details, plus technical data such as your IP address, device information and cookies.
  • We use it to reply to you, deliver our services, and improve our website and marketing.
  • We never sell your personal information.
  • You stay in control. Ask us at any time to see, correct or delete your information, or to stop sending you marketing.

1. Who we are

Mscaler is a growth marketing agency based in Bhadohi, Uttar Pradesh, India, founded by Ashutosh Jaiswal. We help D2C, B2B and service businesses with performance marketing, lead generation, Shopify development and WhatsApp automation.

Mscaler decides how and why your personal information is used, which makes us the “controller” (or “data fiduciary” under Indian law) of that information.

2. Information we collect

Information you give us

  • Contact form: your name, phone number (with country code), email address, brand name or website, monthly ad spend range and your message.
  • Email, WhatsApp, phone and booked calls: your contact details and whatever you choose to tell us.
  • Social media: if you contact us through LinkedIn, Instagram or another platform, your profile name and the information you share with us.
  • Email updates: your email address, if you subscribe.
  • If you become a client: business contact, address and billing details, and the access you give us to your ad accounts, analytics, store or other tools so we can do the work. This is also covered by our service agreement with you.

Information collected automatically

When you visit our website, we and our service providers may collect technical data such as your IP address, browser type, device information, pages visited, the page that referred you, and the date and time of your visit. This is collected through server logs, cookies and similar technologies (see section 5).

Information we don’t want

Please don’t send us sensitive information such as health details, bank or card passwords, government ID numbers or biometric data. We don’t need it.

3. How we collect information

We collect information when you visit our website, fill out a form, contact us by email, WhatsApp or phone, book a call, subscribe to our emails, interact with our ads or social media pages, or pay an invoice.

4. How we use your information

  • To reply to your enquiry and arrange and hold your growth call.
  • To prepare proposals, provide our services, and develop new services.
  • To send invoices, process payments and send important service updates.
  • To send marketing emails or messages, with your consent where the law requires it.
  • To understand how our website is used and to improve its performance.
  • To measure and improve our advertising, including remarketing (see section 6).
  • To keep our website and systems secure, prevent spam and misuse, and meet our legal, tax and accounting obligations.

We do not use your information for automated decision-making or profiling that has legal or similarly significant effects on you.

Legal basis (EU, UK and similar laws): we rely on our legitimate interests (replying to enquiries, improving our website and marketing, keeping our site secure), on taking steps before a contract and performing a contract (proposals and services), on legal obligations (tax and accounting records), and on your consent where required (for example, for non-essential cookies and marketing emails). You can withdraw consent at any time.

5. Cookies and tracking technologies

Cookies are small files stored on your device. Our website may use:

  • Essential cookies that the website needs to work and stay secure.
  • Analytics cookies (such as Google Analytics) that help us understand how visitors use our website so we can improve it.
  • Advertising cookies and pixels (such as the Google Ads tag, Meta Pixel or LinkedIn Insight Tag) that help us measure our campaigns and show relevant ads.

Where the law requires it, such as in the EU and UK, we ask for your consent before using non-essential cookies, and you can change your choice at any time. You can also block or delete cookies in your browser settings, although some parts of the website may not work properly without them.

Do Not Track: our website does not currently respond to “Do Not Track” browser signals, because there is no common standard for them.

6. Advertising and remarketing

We may advertise on platforms such as Google Ads, Meta (Facebook and Instagram), LinkedIn and Microsoft Advertising (Bing). These platforms may use cookies and similar technologies to show our ads to people who have visited our website (remarketing) and to measure how our ads perform. They handle this data under their own privacy policies.

We do not share the details you send us through our contact form with advertising platforms.

You can control the ads you see through Google’s My Ad Center, the ad preferences in your Facebook and Instagram settings, and industry opt-out tools such as optout.aboutads.info (United States) and youronlinechoices.eu (Europe).

7. Email communication

We may email you to reply to your enquiry, share service updates and important information, and, with your consent where required, send marketing or promotional messages. We may use a trusted email or communication service to send these emails. You can unsubscribe from marketing emails at any time using the link in the email or by contacting us.

8. Who we share it with

We never sell your personal information. We only share it with:

  • Service providers who help us run our business, such as our website host (Hostinger) and the email, communication and other software we use.
  • Payment providers and banks, to process payments. We never store your full card details or banking passwords.
  • Analytics and advertising platforms, which receive the technical and cookie data described in sections 5 and 6.
  • WhatsApp (Meta), if you choose to message us on WhatsApp. Those messages are also handled under WhatsApp’s own privacy policy.
  • Professional advisers, such as accountants or lawyers, where needed.
  • Authorities, when we are required to by law or need to protect our rights.
  • A future owner, if Mscaler is ever merged or sold, under the same protections described here.

We require our service providers to keep your information secure and to use it only to provide their services to us.

9. International transfers

We are based in India, and our service providers may store or process information in other countries. When your information moves across borders, we take steps to keep it protected as required by the data protection laws that apply to you.

10. How long we keep it

  • Enquiries that don’t lead to working together: deleted within 24 months of our last contact, or sooner if you ask.
  • Client records: kept for as long as we work together, and afterwards only as long as needed to meet legal, tax and accounting requirements or to resolve disputes.
  • Marketing emails: until you unsubscribe.
  • Technical and cookie data: for the period set by each cookie or service provider, and then deleted.

11. How we protect it

We use reasonable technical and organisational measures to protect your information, including encrypted (HTTPS) connections and limiting access to the people who need it. No system is completely secure, but we work to protect your information and will tell you and the relevant authorities about a data breach where the law requires it.

12. Your rights

Depending on where you live (for example under the GDPR, the CCPA or India’s DPDP Act), you can ask us to:

  • tell you what personal information we hold about you and give you a copy;
  • correct information that is wrong or incomplete;
  • delete your information;
  • stop or limit how we use it, or object to a use;
  • stop sending you marketing;
  • send your information to you or another company in a common format;
  • withdraw any consent you gave us.

How to ask: email ashu@mscaler.com with the subject “Privacy request”. It’s free. We will reply within 30 days and may ask you to confirm your identity first so we don’t share your information with the wrong person. You won’t be treated differently for using your rights.

13. Extra information for your region

European Union, EEA and United Kingdom

You have the rights listed above under the GDPR and UK GDPR, including the right to withdraw your consent to non-essential cookies at any time. If you’re unhappy with how we handle your information, please contact us first. You also have the right to complain to your local data protection authority (in the UK, the Information Commissioner’s Office).

United States (including California)

In the last 12 months we may have collected identifiers (such as name, email, phone number and IP address), professional and commercial information (such as your brand and ad spend range) and internet activity (such as how you use our website). We do not sell personal information for money. If we use advertising cookies or pixels, this may count as “sharing” for cross-context behavioural advertising under California law. You can opt out by emailing us with the subject “Do not sell or share my information” and by blocking advertising cookies in your browser. California residents, and residents of other states with privacy laws such as Virginia, Colorado, Connecticut, Utah and Texas, can also ask to know, access, correct or delete their information, and may use an authorised agent to make a request.

Australia

We handle personal information in line with the Australian Privacy Principles under the Privacy Act 1988. Your information may be held in India and in other countries where our service providers operate. If you have a complaint, contact us first; if you’re not satisfied with our response, you can contact the Office of the Australian Information Commissioner (OAIC).

United Arab Emirates, Saudi Arabia and the Gulf region

If you’re in the UAE, Saudi Arabia, Qatar, Bahrain, Oman or Kuwait, we respect the rights given to you under your local personal data protection laws, including the rights to be informed, to access, correct and delete your information, and to complain to the relevant authority.

India

Under the Digital Personal Data Protection Act, 2023, you can access a summary of your information, ask us to correct or erase it, nominate someone to exercise your rights, and raise a grievance with us. 14. Children

Our services are for businesses and are not directed at children. We don’t knowingly collect personal information from anyone under 18. If you believe a child has sent us their information, contact us and we will delete it.

15. Third-party links

Our website may link to other websites and services, such as WhatsApp, LinkedIn or payment pages. We are not responsible for their privacy practices, and their own privacy policies apply when you use them.

16. Changes to this policy

We may update this Privacy Policy from time to time. We’ll change the “Last updated” date at the top, and the latest version will always be available on this page.
